Apple Faces Potential Ban of Key Privacy Feature in France

French authorities may soon order Apple to disable App Tracking Transparency, a key privacy feature, and impose a substantial fine.

Apple is facing a potential setback in France regarding its App Tracking Transparency (ATT) feature, which allows iPhone users to control whether their activity can be tracked by advertisers. A two-year investigation is expected to conclude unfavorably for Apple next month. The French regulator may order Apple to halt this practice and could impose a fine of up to 10% of the company's global annual revenue. This would mark the first regulatory veto against ATT. The primary concerns are that Apple is allegedly using its dominant position to implement discriminatory, non-objective, and non-transparent conditions for the use of user data in advertising. Apple maintains that ATT empowers users to decide how their data is used and applies equally to all developers, including Apple itself. Similar investigations are ongoing in Germany and Italy, while in the US, concerns have largely come from companies like Meta rather than regulators, who argue that ATT negatively impacts their advertising revenue.
